Another area of development of the tort of passing off in the future is the application of the tort to character merchandising which is a marketing strategy by referencing directly or indirectly to an endorsement by a real or fictional character. It occurs where a trader associates his products to the name, image or distinguishing features of a popular figure to make his products more attractive or noticeable in an effort to hike up the sales of his product or services.
